"Berkut" did abuse power

Uzhgorod Prosecutors proved in court the "Berkut" officer's guilt of a criminal offense under Part 2 of Art. 365 of the Criminal Code of Ukraine (abuse of power or authority).    

   June 16, 2011, the Prosecutors of the Transcarpathian region opened a criminal investigation into the intentional actions, that abuse the granted powers and are violent, committed by a "Berkut" officer.

   Preliminary investigation revealed that in April 2011, in Uzhgorod on Sobranetska street, patrol inspectors documented an administrative violation - driving while intoxicated - committed by resident of Uzhgorod K. The driver complained to the inspectors about the disappearance of his cell phone and demanded to return it. At this time, a "Berkut" officer, abusing his authority, inflicted several blows on the citizen K.

   Uzhgorod prosecutors completely proved the officer's guilt in court. However, Uzhgorod district court judge, taking into account mitigating circumstances, sentenced him to three years imprisonment with disqualification to hold positions in law enforcement for a period of one year and released the convicted from the designated primary punishment, if within one year of probation he does not committ any new crime. Uzhgorod Prosecutors, disagreeing with the sentence due to its inadequacy to the gravity of the crime, filed an appeal.
