Prosecutors cancel illegal decisions of Uzhgorod City Council in court

Prosecutors of Uzhgorod are seeking the cancellation of illegal decisions of Uzhgorod City Council in court. In particular, the Executive Committee of Uzhgorod City Council adopts illegal decisions to establish standing committees, while according to the Law of Ukraine "On Local Self-Government", the decision on formation and elimination of standing committees shall be within the exclusive competence of city councils. Therefore, such decisions are canceled by the courts.

For example, in October 2012 at the meeting of the executive committee, by the decision "On Waste Management", they approved formation of the standing committee on waif waste management. Since this decision is contrary to applicable laws, it was canceled by Transcarpathian District Administrative Court following the suit of Uzhgorod prosecutors. Nevertheless, in October of the same year, by another, similar to the previous one, decision of the executive committee of the city council, they have established the committee to consider applications for provision data and permits for installation of temporary structures. Prosecutors of Uzhgorod became aware of this decision during the inspection carried out for the purpose of supervision over the observance and application of laws in the executive committee of Uzhgorod City Council. Upon the complaint of Uzhgorod city prosecutor, Transcarpathian District Administrative Court canceled this decision. Thus, the said decision was invalidated.
