Transcarpathian policemen who beat a man can be imprisoned for 3 to 8 years

Irshava District Prosecutor’s Office are conducting the pre-trial investigation on the criminal proceedings commenced at the request of a 32-year-old resident Irshava concerning the crime under Part 2 of Art. 365 of the Criminal Code of Ukraine (abuse of power or authority).

According to Irshava District Prosecutor Ivan Rusin, the prosecutor’s office received a statement of a local resident that during the illegal detention at a bus stop in Irshava, officers of the district police department had beaten him and taken to the police station.

Therefore, January 30, prosecutors of Irshava district entered the information about this fact to the URPI and initiated pre-trial investigation on the criminal proceeding.

February 4, the victim again appealed to the prosecutor with a statement that one of the said policemen, when noticing that he was being filmed, took his cell phone.

On the same day, the prosecution entered the relevant data on the specified fact to the URPI and initiated pre-trial investigation into the crime under Part 2 of Art. 365 of the CC of Ukraine.

 Currently the listed criminal proceedings are combined into one, pre-trial investigation continues.

The course of preliminary investigation is under the control of the prosecutor’s office of the region.

Part 2 of Art. 365 of the Criminal Code of Ukraine – abuse of power or authority, if it is accompanied by violence or threats of violence, weapons, or special tools or painful and those that offend personal dignity of the victim’s actions in the absence of signs of torture – is punishable by imprisonment for a term of three to eight years with deprivation of the right to occupy certain positions or engage in certain activities for a term up to three years and with a fine of five hundred to one thousand tax-free minimum incomes.
