In Mizhhirya, the candidate, who had to become the head of the town, was electted the charman of the district council

Following the elections, the town of Mizhhirya in Transcarpathian region still has no mayor, although the winner of the election is known. The latter – Vasyl Shchur – was declared a deputy of the district council and was elected its chairman.

As reported by the OPORA, the current mayor of Mizhhirya Vasyl Shchur won the mayoral elections in the town However, the town election commission has not announced official election results. Later, the court ordered to announce the results of the election of the town head, but it was not done.

As a result, the Central Election Commission dissolved the town election commission and ordered Mizhhirya district election commission to form a new town commission. However, the new commission still has not met to declare Vasyl Shchur the head of Mizhhirya.

Meanwhile, the district election commission recognised Vasyl Shchur a deputy of Mizhhirya district council as a representative of the party "Nash Krai," which overcame the 5-percent barrier.

According to the requirements of part 11 of Article 86 of the Law of Ukraine "On local elections," Vasyl Shchur had no right to choose whether to be a deputy of the district council or the chairman of the town council. The Law is clear – he had to take the position of the town head.

However, since the Election Commission had not announced him the head of the town, formally the District Election Commission had no reason to deny Vasyl Shchur in the mandate of a deputy of the District Council.

As the candidate for Mizhhirya town head from the "Svoboda" Vasyl Baran reported to the OPORA, on Thursday, November 19, Vasyl Shchur was elected the chairman of Mizhhirya district council.

Therefore, as of November 19, the town of Mizhhirya is the only one Transcarpathia where elections were held but there is no town head. 

The OPORA conciders it a manipulation of the legislation of Ukraine. Therefore, they call on the Central Election Commission and law enforcement agencies to investigate into the situation and to take measures within their competence.
