Chop border guards were obliged to register the right to use for defense land

The grounds for the prosecutor’s lawsuit was the illegal inaction of the Chop Border Guard Detachment regarding the proper registration of the right to use the said lands of the border strip. At present, according to the State Land Cadastre, they are registered as vacant agricultural land plots, which contributed to the formation of the so-called private border.

It should be noted that often the failure of state border guards to document the use of defense lands is the cause of systematic and daring attempts to illegally privatize them. And the land can be subject of civil rights only from the moment of its formation and state registration of the right to it.

The court of higher instance found that the units of the State Border Guard Service, in accordance with the requirements of the law, are obliged to implement the establishment of a border strip at the state border as a zone of special land use regime. Thus, the Transcarpathian Regional Prosecutor’s Office prevented potential attempts by certain persons to illegally privatize the lands of the border zone, which could be further used for crimes related to smuggling, illegal migration, etc.
