Apartment for Kasperov: Prosecutor appealed the allocation of housing in court

Uzhgorod City Prosecutor sent to Uzhgorod district court the claim "On the abolition of Section 1.6 of the Executive Committee decision number 227 dated 26.06.2013 and the invalidation of the lease agreement dd. 02.07.2013" – Zakarpattya online reported.
The defendants under the statement of claim are the Executive Committee of Uzhgorod City Council, "Nash-Dobrobut" LLC and personally, the Director of the Municipal Economy Department of Uzhgorod City Council Oleksiy Kasperov.
As stated in the lawsuit, "the inspection, conducted by prosecutors of Uzhgorod, revealed violations of housing legislation in the decision adopted by the executive committee of Uzhgorod City Council."
As the prosecutor noted, "the decision of the Executive Committee of Uzhgorod City Council number 227 dated 26.06.2013 regarding the lease agreement for the apartment (with O.Kasperov – Ed.) was adopted in violation of applicable law, and therefore it shall be deemed unlawful and canceled…" – the site informed.
"Taking into account the above, according to Art.19, 121, 144 of the Constitution of Ukraine, Art. 20, 36-1 of the Law of Ukraine "On Prosecutor’s Office", Art.15, 45.118, 122 of the Civil Procedure Code of Ukraine," the Uzhgorod prosecutor asked the court to:
"1.   Open the proceeding on the case.
2.   Declare illegal and annul Section 1.6 of the decision of the Executive Committee of Uzhgorod City Council number 227 dd. 26.06.2013.
3.   Invalidate the agreement for lease of the apartment number 26 on Sobranetska street, 146 in Uzhgorod dd. 07.02.2013, concluded between "Nash-Dobrobut" LLC and O. Kasperov."
By the way, recently at the press conference, the prosecutor Volodymyr Korban, answering uzhgorod.in’s questions about the case, informed that they had initiated the verification of the information contained in the publication, and that there were grounds to appeal the decision.
