September 16, 2013, Uzhgorod City and District Court considered the criminal proceeding on the grounds of Part 1 of Art. 246 of the Criminal Code of Ukraine (illegal cutting of forests) against the citizen M., who in March 2013, in Uzhgorod military forestry woodland illegally felled oak trees. His actions caused damages to the state amounting to about 30,000 UAH. Imposing penalties for committing the above crime, the court took into account that the citizen M. on January 2013 had been convicted of crimes under Parts 1, 2 of Art. 185 (theft) and Part 2 of Art. 190 (cheating) to 5 years in prison and under Art. 75 of the Criminal Code of Ukraine had been released from serving the sentence with the probation period of 2 years 6 months.
The court agreed with the proposal of the public prosecutor and, on the basis of
Art. 71 of the Criminal Code of Ukraine, added the unserved part of the punishment under the previous sentence.
According to the First Deputy Prosecutor of the Western Ukraine Yevhen Paramonov, the final sentence imposed by the court is the imprisonment for 5 years 2 months with forfeiture of illegally gained items. The court granted the prosecutor’s civil suit for compensation of caused losses totaling almost 30,000 UAH.
The citizen M. was taken into custody in the courtroom.
